{"id":1402,"date":"2019-09-04T10:06:36","date_gmt":"2019-09-04T15:06:36","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1402"},"modified":"2019-09-04T10:06:36","modified_gmt":"2019-09-04T15:06:36","slug":"jurisdiction-in-texas-divorce","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/jurisdiction-in-texas-divorce\/","title":{"rendered":"Jurisdiction in Texas Divorce"},"content":{"rendered":"<p>In some Texas custody cases, the parents live near each other and where the case will be heard is not an issue.\u00a0 In other cases, however, one parent has moved away and there may be a dispute over jurisdiction.\u00a0 Although the child\u2019s home state generally has jurisdiction, there are circumstances where the child does not have a home state.<\/p>\n<p>In a <a href=\"https:\/\/cases.justia.com\/texas\/sixth-court-of-appeals\/2019-06-19-00015-cv.pdf?ts=1566476145\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, a mother challenged the Texas court\u2019s jurisdiction over the child\u2019s custody.\u00a0 The family lived in South Carolina when the child was born, but moved to Texas a few months later.\u00a0 They went to Michigan to celebrate the child\u2019s first birthday. The father said it was a vacation, but the mother said she planned to move to Michigan then.\u00a0 They all went back to Texas, but the mother moved to Michigan with the child early the next month.<\/p>\n<p>The father then filed suit seeking temporary child custody orders in Texas.\u00a0 He sought the exclusive right to designate the child\u2019s primary residence.\u00a0 The Texas court entered temporary orders.
