{"id":1383,"date":"2019-08-14T09:30:41","date_gmt":"2019-08-14T14:30:41","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1383"},"modified":"2019-08-14T09:30:41","modified_gmt":"2019-08-14T14:30:41","slug":"texas-court-awards-custody-to-stepfather","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-awards-custody-to-stepfather\/","title":{"rendered":"Texas Court Awards Custody to Stepfather"},"content":{"rendered":"<p>It can be very difficult for a non-parent to get custody of a child in Texas custody cases.\u00a0 A presumptive father may, however, have an advantage over other non-parents.\u00a0 In a <a href=\"https:\/\/cases.justia.com\/texas\/sixth-court-of-appeals\/2019-06-18-00047-cv-0.pdf?ts=1565104584\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, the appeals court found a presumptive father did not have to establish non-parent standing even though the court adjudicated someone else as the child\u2019s father.<\/p>\n<p>The biological father challenged the order appointing him, the child\u2019s mother, and the mother\u2019s former husband joint managing conservators with the stepfather having the right to establish the child\u2019s residence. The biological father had intervened in the divorce proceeding between the mother and her husband.
