{"id":1371,"date":"2019-08-07T10:49:36","date_gmt":"2019-08-07T15:49:36","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1371"},"modified":"2019-08-07T10:49:36","modified_gmt":"2019-08-07T15:49:36","slug":"texas-court-may-not-make-substantive-change-when-clarifying-a-custody-order","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-may-not-make-substantive-change-when-clarifying-a-custody-order\/","title":{"rendered":"Texas Court May Not Make Substantive Change When Clarifying a Custody Order"},"content":{"rendered":"<p>Most Texas custody cases are between a child\u2019s parents, but in some cases other family members may be involved.\u00a0 In a <a href=\"https:\/\/cases.justia.com\/texas\/first-court-of-appeals\/2019-01-18-00234-cv.pdf?ts=1563280333\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, an uncle challenged a modification of the access and possession terms of a court order related to his brother&#8217;s child.\u00a0 Although the trial court expressed an intention to clarify the original order, the appeals court found it had improperly made a substantive change.<\/p>\n<p>The child\u2019s father is deceased.\u00a0 In 2016, the father\u2019s brother filed suit to be named as the child\u2019s primary conservator.\u00a0 The uncle and the mother ultimately reached an agreement, which was incorporated by the court\u2019s order.\u00a0 The order gave primary possession to the uncle and periodic possession to the mother.\u00a0 The uncle had the right to request the mother undergo drug testing once a month.\u00a0 She was required to appear for drug testing at a designated location within 24 hours of the uncle sending notice.\u00a0 The uncle was prohibited from sending notice Friday through Sunday at 9:00 a.m. If the mother failed to appear within 24 hours, the results would be deemed positive.\u00a0 If the drug test results were positive or deemed positive, the mother\u2019s periods of possession would be suspended until there was a further court order.<\/p>\n<p>The mother moved to enforce the order a month after it was entered.\u00a0 She alleged the uncle did not make the child available to her during her time.\u00a0 She sought criminal and civil contempt, additional periods of possession, and attorney\u2019s fees.\u00a0 She also asked the court to clarify the original order if it found any part of it was insufficiently specific to be enforced through contempt.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-may-not-make-substantive-change-when-clarifying-a-custody-order\/#more-1371\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Most Texas custody cases are between a child\u2019s parents, but in some cases other family members may be involved.\u00a0 In a recent case, an uncle challenged a modification of the access and possession terms of a court order related to his brother&#8217;s child.\u00a0 Although the trial court expressed an intention to clarify the original order, [&hellip;]<\/p>\n","protected":false},"author":13,"featured_media":1381,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[23],"tags":[],"class_list":["post-1371","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-child-custody"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.7 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Texas Court May Not Make Substantive Change When Clarifying a Custody Order &#8212;
