Now what?"},"content":{"rendered":"<p>For\u00a0the\u00a0parents of a brand new\u00a0baby boy, oftentimes the first medical decision to be made for the child is whether he should be circumcised.\u00a0 This medical procedure is usually performed\u00a0in the hospital\u00a0shortly after the birth of the child\u00a0and outside the presence of the parents, or in the Jewish faith,\u00a0eight days after the\u00a0birth of the baby boy, which is part of the <em>brit milah <\/em>(a.k.a. <em>bris<\/em>) ritual.\u00a0 But what happens when the parents do not agree on whether their baby\u00a0should be circumcised?\u00a0 What legal recourse do the\u00a0parents have in Texas?\u00a0 The answer is not an easy one.<\/p>\n<p>In Texas, parents can legally resolve their disputes\u00a0in a &#8220;Suit Affecting the Parent-Child Relationship&#8221; (&#8220;SAPCR&#8221;) wherein the Court is asked to appoint the parents with certain rights, powers, and duties over their child.\u00a0 The problem in the case of circumcision, however, is that a SAPCR may not be filed for an unborn child.\u00a0 Therefore, if a parent has a strong objection to circumcision, then he or she must wait until after the child is born to prevent an unwanted circumcision and then act quickly.\u00a0 Assuming that the medical professionals\u00a0will not perform the procedure against one parent&#8217;s clear objection, the objecting parent will need to\u00a0file a SAPCR immediately and request a Temporary Restraining\u00a0Order to prohibit the non-objecting party from consenting to the circumcision\u00a0until the Court cannot decide the matter after notice and hearing.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/congratulations-on-the-birth-of-your-baby-boy-now-what\/#more-136\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>For\u00a0the\u00a0parents of a brand new\u00a0baby boy, oftentimes the first medical decision to be made for the child is whether he should be circumcised.\u00a0 This medical procedure is usually performed\u00a0in the hospital\u00a0shortly after the birth of the child\u00a0and outside the presence of the parents, or in the Jewish faith,\u00a0eight days after the\u00a0birth of the baby boy, [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[25],"tags":[44,45,46],"class_list":["post-136","post","type-post","status-publish","format-standard","hentry","category-parental-rights","tag-medical-decisions","tag-parental-rights","tag-unborn-child"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.7 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Congratulations on the birth of your baby boy!
