{"id":1332,"date":"2019-07-03T09:44:32","date_gmt":"2019-07-03T14:44:32","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1332"},"modified":"2021-09-30T13:38:42","modified_gmt":"2021-09-30T18:38:42","slug":"divorcing-an-adulterer-in-texas","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/divorcing-an-adulterer-in-texas\/","title":{"rendered":"Divorcing an Adulterer in Texas"},"content":{"rendered":"<p>Adultery can have a devastating effect on the wronged spouse and on a marriage. \u00a0When adultery leads to a Texas divorce, the wronged spouse has the option of raising the issue of adultery in the divorce or allowing the divorce to be granted without fault.<\/p>\n<p>Texas recognizes no-fault divorce, but also still has fault-based grounds for divorce.\u00a0 A Texas divorce court may either grant a no-fault divorce upon a finding that the marriage is insupportable due to discord or conflict or it may grant a divorce based on fault for certain reasons, such as cruelty or <a href=\"https:\/\/texas.public.law\/statutes\/tex._fam._code_section_6.003\" target=\"_blank\" rel=\"noopener noreferrer\">adultery<\/a>.\u00a0 The court has the discretion to determine whether the divorce will be granted on insupportability or fault-based grounds.\u00a0 Even if there is uncontroverted and sufficient evidence of adultery, the court has the discretion to grant a no-fault divorce.\u00a0 The presence of adultery in the marriage, therefore, does not necessarily mean that the divorce will be granted based on adultery.<\/p>\n<p>Although divorce can be granted without fault, there can be benefits to obtaining a divorce based on the other party\u2019s fault.\u00a0 A finding of fault can have a significant impact on property division and in some cases can also affect custody.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/divorcing-an-adulterer-in-texas\/#more-1332\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Adultery can have a devastating effect on the wronged spouse and on a marriage. \u00a0When adultery leads to a Texas divorce, the wronged spouse has the option of raising the issue of adultery in the divorce or allowing the divorce to be granted without fault.
