{"id":1318,"date":"2019-07-24T10:29:30","date_gmt":"2019-07-24T15:29:30","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1318"},"modified":"2019-07-24T10:29:30","modified_gmt":"2019-07-24T15:29:30","slug":"award-of-retirement-increases-in-texas-divorce","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/award-of-retirement-increases-in-texas-divorce\/","title":{"rendered":"Award of Retirement Increases in Texas Divorce"},"content":{"rendered":"<p>Retirement can be a complex issue in Texas divorce cases.\u00a0 In some cases, retirement accounts may not be fully vested.\u00a0 In others, retirement income may be subject to periodic increases.\u00a0 When retirement income is subject to increases, the spouse required to make ongoing payments should be sure he or she understands how to calculate those payments in light of the increases.<\/p>\n<p>A former couple recently ended up <a href=\"https:\/\/cases.justia.com\/texas\/eighth-court-of-appeals\/2019-08-15-00339-cv.pdf?ts=1559834360\" target=\"_blank\" rel=\"noopener noreferrer\">back in court<\/a> more than a decade after their divorce due to a dispute over how to calculate retirement increases.\u00a0 The couple married in 1976 and divorced in 1998, after the husband\u2019s retirement from the military.\u00a0 The wife was awarded $754.80 per month of the husband\u2019s retirement, and 60% of all increases \u201cdue to cost of living or other reasons\u2026\u201d\u00a0 The husband was ordered to name the wife beneficiary under the Armed Services Survivor Benefit Plan (SBP).\u00a0 The wife was ordered to pay 40% of the cost of the SBP, which was to offset the retirement award the wife received.<\/p>\n<p>In 2012, the wife informed the husband he had underpaid her.\u00a0 His new attorney told him he had been calculating his payments incorrectly.
