{"id":1294,"date":"2019-06-19T09:05:50","date_gmt":"2019-06-19T14:05:50","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1294"},"modified":"2021-09-30T13:38:42","modified_gmt":"2021-09-30T18:38:42","slug":"court-may-order-battering-intervention-and-prevention-program-in-texas-custody-case","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/court-may-order-battering-intervention-and-prevention-program-in-texas-custody-case\/","title":{"rendered":"Court May Order Battering Intervention and Prevention Program in Texas Custody Case"},"content":{"rendered":"<p>In Texas custody cases, the best interests of the child are the primary consideration, and the court uses broad discretion in determining them.\u00a0 If the court finds it is in the child\u2019s best interest to do so, it may limit a parent\u2019s visitation with the child or increase a parent\u2019s time with the child, but only if certain conditions are met.\u00a0 A father <a href=\"https:\/\/cases.justia.com\/texas\/third-court-of-appeals\/2019-03-17-00796-cv.pdf?ts=1555676081\" target=\"_blank\" rel=\"noopener noreferrer\">recently challenged<\/a> a court\u2019s order that he would have to complete a Battering Intervention and Prevention Program before the possession schedule could change.<\/p>\n<p>The parents lived together with the child until the mother moved out of the home.\u00a0 The father filed suit, asking to be named joint-managing conservator and to have the exclusive right to designate the child\u2019s primary residence.\u00a0 A jury found the parents should be joint-managing conservators.\u00a0Although the jury gave the father the exclusive right to designate residence, it placed a geographic restriction on that right.<\/p>\n<p>When the court issued the order, it left the temporary orders for possession in place until the father finished a Battering Intervention and Prevention Program.
