{"id":1287,"date":"2019-04-19T11:44:13","date_gmt":"2019-04-19T16:44:13","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1287"},"modified":"2019-04-19T11:44:13","modified_gmt":"2019-04-19T16:44:13","slug":"separate-property-in-texas-divorce-includes-property-claimed-by-one-spouse-before-marriage","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/separate-property-in-texas-divorce-includes-property-claimed-by-one-spouse-before-marriage\/","title":{"rendered":"Separate Property in Texas Divorce Includes Property Claimed by One Spouse Before Marriage"},"content":{"rendered":"<p>In a Texas divorce, there is a presumption that property possessed by either spouse during the marriage or at the time of the divorce is community property, unless there is clear and convincing evidence otherwise.\u00a0 Separate property is property that is owned or claimed by one spouse prior to the marriage.<\/p>\n<p>A wife <a href=\"https:\/\/cases.justia.com\/texas\/seventh-court-of-appeals\/2019-07-18-00050-cv.pdf?ts=1555418608\" target=\"_blank\" rel=\"noopener noreferrer\">recently challenged<\/a> a court\u2019s finding that certain property, the couple\u2019s residence, was the husband\u2019s separate property.\u00a0 The property was conveyed to the couple from the husband\u2019s son and daughter-in-law by warranty deed.\u00a0 The husband and wife both testified the conveyance was a trade of real property and there was no additional consideration given.\u00a0 The husband testified he traded a tract of land he owned before the marriage.\u00a0 The wife argued, however, that the husband did not establish that he owned the tract prior to the marriage.<\/p>\n<p>If property is acquired in exchange for separate property, the acquired property also becomes separate property.
