{"id":1263,"date":"2019-03-28T08:49:23","date_gmt":"2019-03-28T13:49:23","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1263"},"modified":"2019-03-28T08:49:23","modified_gmt":"2019-03-28T13:49:23","slug":"texas-custody-modification-requires-material-and-substantial-change-that-affects-the-child","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-custody-modification-requires-material-and-substantial-change-that-affects-the-child\/","title":{"rendered":"Texas Custody Modification Requires Material and Substantial Change that Affects the Child"},"content":{"rendered":"<p>Modification of a Texas custody order can generally only occur on agreement of the parties or when there is a material and substantial change in circumstances.\u00a0 However, the change in circumstances alone is not sufficient to justify modification, the modification must also be in the child\u2019s best interests.<\/p>\n<p>In a <a href=\"https:\/\/cases.justia.com\/texas\/fourteenth-court-of-appeals\/2019-14-17-00715-cv.pdf?ts=1552471115\">recent case<\/a>, a father challenged a trial court\u2019s denial of his petition to modify custody. \u00a0He argued the trial court abused its discretion in finding there was no material or substantive change, allowing the mother to be joint-managing conservator and failing to render a possession order in his favor.<\/p>\n<p>The original order was modified in 2015.\u00a0 In 2016, the father petitioned to modify the order, asking\u00a0to be named sole-managing conservator with the sole right to designate the child\u2019s primary residence.\u00a0 He alternatively requested the court name him joint-managing conservator with all the exclusive rights of a managing conservator or with the sole right to designate primary residence and expanded possession.\u00a0 He asked the court to either deny the mother access to the child or to have her access supervised.<\/p>\n<div class=\"read_more_link\"><a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-custody-modification-requires-material-and-substantial-change-that-affects-the-child\/\"  title=\"Continue Reading Texas Custody Modification Requires Material and Substantial Change that Affects the Child\" class=\"more-link\">Continue Reading \u203a<\/a><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Modification of a Texas custody order can generally only occur on agreement of the parties or when there is a material and substantial change in circumstances.\u00a0 However, the change in circumstances alone is not sufficient to justify modification, the modification must also be in the child\u2019s best interests.
