{"id":1243,"date":"2019-02-25T09:00:11","date_gmt":"2019-02-25T15:00:11","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1243"},"modified":"2021-09-30T13:38:44","modified_gmt":"2021-09-30T18:38:44","slug":"texas-court-allows-mother-to-change-childrens-last-name","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-allows-mother-to-change-childrens-last-name\/","title":{"rendered":"Texas Court Allows Mother to Change Children&#8217;s Last Name"},"content":{"rendered":"<p>Most Texas divorces address property division and custody and visitation issues, where there are children.\u00a0 In some cases, however, there are more unusual issues that must be addressed.\u00a0 In one <a href=\"https:\/\/cases.justia.com\/texas\/fourteenth-court-of-appeals\/2019-14-17-00216-cv.pdf?ts=1549979561\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, a father challenged a court\u2019s order allowing the mother to change the children\u2019s last name from their father\u2019s name to their mother\u2019s maiden name.<\/p>\n<p>The parents had two children together.\u00a0 The father is currently serving a life sentence without parole for an offense that occurred when his children were one and three years old.\u00a0 The mother petitioned for divorce.\u00a0 She requested to be appointed sole managing conservator, to change the children\u2019s name, and to keep the father from having contact with the children.<\/p>\n<p>The mother testified that the father\u2019s family did not help after he was incarcerated.\u00a0 She thought contact with the father would threaten the kids\u2019 emotional welfare.\u00a0 She testified that the father was a former gang member and she was afraid of him.
