FAM. CODE ANN. \u00a7 2.401.\u00a0 Texas courts have held that evidence that the parties held themselves out as married must be particularly convincing and be more than occasional references to each other as husband or wife.<\/p>\n<p>A mother recently <a href=\"https:\/\/cases.justia.com\/texas\/fifth-court-of-appeals\/2019-05-18-00452-cv.pdf?ts=1548759198\" target=\"_blank\" rel=\"noopener noreferrer\">challenged<\/a> a court\u2019s finding that she had not been informally married to the father of her children.\u00a0 The couple had two children together, one who was six and the other who was 21.\u00a0 The mother petitioned for divorce, arguing that she and the father married on or about 1996.\u00a0 In his answer, the father stated there was no existing marriage.<\/p>\n<p>At the hearing, the mother testified that she believed she and the father had agreed to be informally married when they moved in together.\u00a0 She said the father introduced her to his friends and family as his wife.\u00a0 She admitted, however, that she always filed her taxes as single.\u00a0 She also conceded that her name was not on the deed to the house, and it instead named the father and his father as the owners.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-upholds-finding-of-no-informal-marriage\/#more-1235\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Usually, in a Texas divorce case, both parties know and agree that they were married.\u00a0 In some cases, however, the parties may disagree as to whether there has been an informal marriage.\u00a0 An informal marriage can be proven by showing that the couple agreed to be married, subsequently lived together in Texas as spouses, and [&hellip;]<\/p>\n","protected":false},"author":13,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4,97],"tags":[],"class_list":["post-1235","post","type-post","status-publish","format-standard","hentry","category-divorce","category-informal-marriage"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Texas Appeals Court Upholds Finding of No Informal Marriage &#8212;
