{"id":1203,"date":"2019-01-07T09:00:10","date_gmt":"2019-01-07T15:00:10","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1203"},"modified":"2019-01-07T09:00:10","modified_gmt":"2019-01-07T15:00:10","slug":"texas-appeals-court-reverses-property-division-due-to-lack-of-evidence","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-reverses-property-division-due-to-lack-of-evidence\/","title":{"rendered":"Texas Appeals Court Reverses Property Division Due to Lack of Evidence"},"content":{"rendered":"<p>Property division in a Texas divorce must be just and right.\u00a0 The property division may be \u201cjust and right\u201d in a case where one party does not participate, but the court must have sufficient information to use its discretion in dividing the property fairly.\u00a0 A spouse <a href=\"https:\/\/cases.justia.com\/texas\/first-court-of-appeals\/2018-01-18-00082-cv.pdf?ts=1545142941\" target=\"_blank\" rel=\"noopener noreferrer\">recently challenged<\/a>\u00a0the property division following a proceeding in which he did not participate.<\/p>\n<p>One spouse petitioned for divorce in July 2017, alleging insupportability, which is the &#8220;no fault&#8221;
