{"id":1189,"date":"2018-12-24T10:53:16","date_gmt":"2018-12-24T16:53:16","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1189"},"modified":"2021-09-30T13:38:46","modified_gmt":"2021-09-30T18:38:46","slug":"texas-appeals-court-finds-property-division-in-divorce-was-just","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-appeals-court-finds-property-division-in-divorce-was-just\/","title":{"rendered":"Texas Appeals Court Finds Property Division in Divorce Was Just"},"content":{"rendered":"<p>Property in a Texas divorce must be divided in a \u201cjust and right\u201d manner.\u00a0 The trial court has broad discretion in dividing the estate.\u00a0 To successfully challenge a property division, a party must show that it was so unjust as to constitute an abuse of the trial court\u2019s discretion.<\/p>\n<p>A husband recently <a href=\"https:\/\/cases.justia.com\/texas\/sixth-court-of-appeals\/2018-06-18-00041-cv.pdf?ts=1544189925\" target=\"_blank\" rel=\"noopener noreferrer\">challenged<\/a> the property division in his divorce. The husband appealed the trial court\u2019s ruling, arguing it erred in awarding the wife what he claimed was \u201c75% of the Community Estate.\u201d He argued that the court had awarded her 75% of the community estate by awarding her the home the couple had lived in for most of their marriage and the surrounding property.\u00a0 He also argued the court had improperly characterized real estate owned by his son as community property. Additionally, he argued the court had not considered that community work and assets had been used to enhance the wife\u2019s separate property, that the wife damaged the business awarded to him, that she removed funds from community bank accounts, and committed adultery and domestic violence.<\/p>\n<p><strong>Fault<\/strong><\/p>\n<p>The appeals court first addressed the issue of fault. \u00a0The trial court had granted a no-fault divorce.
