{"id":1187,"date":"2018-12-14T11:00:04","date_gmt":"2018-12-14T17:00:04","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1187"},"modified":"2018-12-14T11:00:04","modified_gmt":"2018-12-14T17:00:04","slug":"texas-court-finds-father-underemployed-and-orders-retroactive-support","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-finds-father-underemployed-and-orders-retroactive-support\/","title":{"rendered":"Texas Court Finds Father Underemployed and Orders Retroactive Support"},"content":{"rendered":"<p>In some Texas child support cases, the court may find a party to be \u201cintentionally underemployed.\u201d Although child support is generally based on the party\u2019s income and resources, the calculation may be based on earning capacity if the party is found to be intentionally underemployed or unemployed.<\/p>\n<p>A father recently <a href=\"https:\/\/cases.justia.com\/texas\/fourteenth-court-of-appeals\/2018-14-16-00856-cv.pdf?ts=1544189951\" target=\"_blank\" rel=\"noopener noreferrer\">challenged<\/a> a child support obligation in which he was found to be intentionally underemployed.\u00a0 The father had petitioned for the bill of review on the grounds the child support determination had been based on an IRS tax-lien notice that contained incorrect information.\u00a0 He alleged he had amended his earnings information with the IRS and asked the court to order a reasonable amount based on his true earnings.
