{"id":1178,"date":"2018-11-28T21:22:44","date_gmt":"2018-11-29T03:22:44","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1178"},"modified":"2018-11-28T21:22:44","modified_gmt":"2018-11-29T03:22:44","slug":"texas-court-erred-in-dismissing-motion-for-clarifying-order-in-custody-case","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-erred-in-dismissing-motion-for-clarifying-order-in-custody-case\/","title":{"rendered":"Texas Court Erred in Dismissing Motion for Clarifying Order in Custody Case"},"content":{"rendered":"<p>A parent can seek enforcement of the custody provisions of a court order through contempt of court.\u00a0 Texas custody attorneys know, however, that contempt is only available if the original order is clear and specific enough to allow the other person to readily know what duties or obligations are expected of him or her.<\/p>\n<p>In a <a href=\"https:\/\/cases.justia.com\/texas\/fourteenth-court-of-appeals\/2018-14-17-00896-cv.pdf?ts=1542722719\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, a father\u00a0sought contempt against his child\u2019s mother.\u00a0 The father moved for enforcement of possession or access to his child.\u00a0 He asked that the court hold the child\u2019s mother in contempt for violating his visitation rights in the divorce decree.\u00a0 In the alternative, he requested that the court issue a clarifying order if it found the previous order was not specific enough to enforce through contempt.\u00a0 The mother moved to dismiss the motion.
