{"id":1118,"date":"2018-09-20T21:27:02","date_gmt":"2018-09-21T02:27:02","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1118"},"modified":"2018-09-20T21:27:02","modified_gmt":"2018-09-21T02:27:02","slug":"texas-custody-modification-and-best-interest-of-the-child","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-custody-modification-and-best-interest-of-the-child\/","title":{"rendered":"Texas Custody Modification and Best Interest of the Child"},"content":{"rendered":"<p>In Texas custody cases, the best interest of the child is to be the primary consideration.\u00a0 In Texas, courts may consider a variety of factors in determining what is in the child\u2019s best interest.\u00a0 These factors include the child\u2019s desires, the child\u2019s current and future physical and emotional needs, any current or future physical or emotional danger to the child, parental abilities of those seeking custody, the programs available to each party, each party\u2019s plans for the child, the stability of the home, any acts or omissions of the parent that could indicate the relationship with the child is not proper, and any excuse for those acts or omissions.\u00a0 The court is not limited to these factors, nor does it have to consider all of them.<\/p>\n<p>In a <a href=\"https:\/\/cases.justia.com\/texas\/third-court-of-appeals\/2018-03-17-00532-cv.pdf?ts=1536323321\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, a father challenged a court\u2019s finding that granting the mother the right to determine the children\u2019s primary residence was in the children\u2019s best interest.\u00a0 The parents\u2019 relationship ended shortly after their twin sons were born in 2011.\u00a0 The trial court originally appointed the parents joint managing conservators and gave the mother the exclusive right to designate the children\u2019s primary residence.\u00a0 A modification in 2014 gave the father the exclusive right to determine primary residence and allowed the mother access to the children under a schedule.\u00a0 Pursuant to the order, the mother had the option to pick up the children on evenings the father was scheduled to work later than 10 pm.<\/p>\n<p>The mother petitioned for the right to determine the primary residence in 2016.\u00a0 She testified the father had his sister take care of the children when he was not available and prevented her from accessing them.\u00a0 She testified she thought the children lived with their father\u2019s sister.\u00a0 She argued she could provide them more structure and stability than their father could.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-custody-modification-and-best-interest-of-the-child\/#more-1118\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In Texas custody cases, the best interest of the child is to be the primary consideration.\u00a0 In Texas, courts may consider a variety of factors in determining what is in the child\u2019s best interest.\u00a0 These factors include the child\u2019s desires, the child\u2019s current and future physical and emotional needs, any current or future physical or [&hellip;]<\/p>\n","protected":false},"author":13,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[23],"tags":[],"class_list":["post-1118","post","type-post","status-publish","format-standard","hentry","category-child-custody"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Texas Custody Modification and Best Interest of the Child &#8212;
