{"id":1084,"date":"2018-08-15T10:37:52","date_gmt":"2018-08-15T15:37:52","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1084"},"modified":"2018-08-15T10:37:52","modified_gmt":"2018-08-15T15:37:52","slug":"proving-informal-marriage-in-texas","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/proving-informal-marriage-in-texas\/","title":{"rendered":"Proving Informal Marriage in Texas"},"content":{"rendered":"<p>In Texas, an informal or common law marriage can occur if the couple executed an informal marriage agreement pursuant to Texas law or agreed to be married and subsequently lived together as married in Texas and represented to others that they were married.<\/p>\n<p>A Texas court <a href=\"https:\/\/cases.justia.com\/texas\/seventh-court-of-appeals\/2018-07-17-00394-cv.pdf?ts=1533304163\" target=\"_blank\" rel=\"noopener noreferrer\">recently found<\/a> that a couple did not have an informal marriage, despite filing their taxes as \u201cmarried filing jointly.\u201d The couple began dating in 2003 or 2004.\u00a0 The man proposed in 2005, and the woman accepted.\u00a0 They moved to Texas together in 2006.\u00a0 They wanted to build a horse clinic where the man would practice veterinary medicine and the woman would train horses.\u00a0 They purchased property together and built the clinic.\u00a0 They had joint bank accounts, but the bookkeeping for each business was kept separate.<\/p>\n<p>They filed joint tax returns indicating they were \u201cmarried filing jointly\u201d from 2006 to 2013.\u00a0 They co-habitated until 2013.\u00a0 The woman filed for divorce in 2015.\u00a0 After a bench trial, the trial court found the couple did not have an informal marriage and dismissed the divorce case.\u00a0 The woman appealed.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/proving-informal-marriage-in-texas\/#more-1084\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In Texas, an informal or common law marriage can occur if the couple executed an informal marriage agreement pursuant to Texas law or agreed to be married and subsequently lived together as married in Texas and represented to others that they were married.
