{"id":1079,"date":"2018-08-07T01:37:59","date_gmt":"2018-08-07T06:37:59","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1079"},"modified":"2018-08-07T01:37:59","modified_gmt":"2018-08-07T06:37:59","slug":"court-can-disproportionately-distribute-assets-due-to-fraud-in-texas-divorce","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/court-can-disproportionately-distribute-assets-due-to-fraud-in-texas-divorce\/","title":{"rendered":"Court Can Disproportionately Distribute Assets Due to Fraud in Texas Divorce"},"content":{"rendered":"<p>A spouse who improperly spends large amounts of community assets without the other spouse\u2019s knowledge or consent may receive a smaller share of the remaining community estate during a Texas divorce.\u00a0 A Texas appeals court <a href=\"https:\/\/cases.justia.com\/texas\/fourteenth-court-of-appeals\/2018-14-17-00175-cv.pdf?ts=1532435507\" target=\"_blank\" rel=\"noopener noreferrer\">recently<\/a> considered whether a property division was just and right after the trial court found the husband had committed fraud on the estate by spending money on other women.The wife filed for divorce after learning her husband had been unfaithful.\u00a0 The husband testified to having affairs for the past 30 years.\u00a0 He took the other women on trips and shopping sprees, paid their rent and car payments, and hired some of them and gave some of them money for their own start-ups.\u00a0 He paid for these things through his business accounts, company credit cards, and petty cash from his pharmacy.<\/p>\n<p>The wife hired a CPA to provide an accounting of the husband\u2019s businesses.\u00a0 The CPA rendered an opinion that more than $7 million was either missing or spent in transactions that did not benefit the community estate.<\/p>\n<p>The husband rejected the amount identified by the wife\u2019s CPA, claiming a large portion of the amount identified did not exist.
