{"id":1048,"date":"2018-06-12T13:54:28","date_gmt":"2018-06-12T18:54:28","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1048"},"modified":"2021-09-30T13:38:49","modified_gmt":"2021-09-30T18:38:49","slug":"spouse-may-be-required-to-reimburse-community-estate-in-texas-divorce","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/spouse-may-be-required-to-reimburse-community-estate-in-texas-divorce\/","title":{"rendered":"Spouse May Be Required to Reimburse Community Estate in Texas Divorce"},"content":{"rendered":"<p>When one spouse controls the finances, he or she has the opportunity to use community assets to the benefit of separate property.\u00a0 The other spouse may challenge the disposition of those funds during a Texas divorce.\u00a0 The spouse in control of the finances has a fiduciary duty to the other spouse during the course of the marriage.<\/p>\n<p>A Texas <a href=\"https:\/\/cases.justia.com\/texas\/third-court-of-appeals\/2018-03-16-00753-cv.pdf?ts=1529065660\" target=\"_blank\" rel=\"noopener noreferrer\">appeals court<\/a> recently considered whether a husband was required to reimburse the community estate for certain expenditures.\u00a0 The trial court awarded the wife the majority of the community estate and ordered the husband to reimburse it for certain expenditures.\u00a0 The husband appealed, arguing the evidence did not support the disproportionate division and some of the amounts he was ordered to reimburse.<\/p>\n<p>The husband had entered the marriage a wealthy man with several businesses.\u00a0 The wife alleged he allowed his separate companies to keep funds he should have received.\u00a0 Since his businesses were S corps, he was personally responsible for paying taxes on the funds, even if they were not distributed.\u00a0 The wife sought reimbursement for the undistributed funds and for the income taxes paid from the community estate.\u00a0 Each party presented expert testimony.\u00a0 The wife\u2019s expert calculated that the estate had paid $1,000,742 in taxes for the separate companies and was entitled to reimbursement.\u00a0 The husband\u2019s expert said he did not agree the wife had a valid claim for reimbursement and presented his own calculations, showing $841,108 was paid.\u00a0 The jury found the community estate had paid $841,108 in income taxes for the husband\u2019s separate businesses.\u00a0 The trial court included that amount in the valuation of the reconstituted community estate.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/spouse-may-be-required-to-reimburse-community-estate-in-texas-divorce\/#more-1048\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>When one spouse controls the finances, he or she has the opportunity to use community assets to the benefit of separate property.\u00a0 The other spouse may challenge the disposition of those funds during a Texas divorce.\u00a0 The spouse in control of the finances has a fiduciary duty to the other spouse during the course of [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[4,27],"tags":[],"class_list":["post-1048","post","type-post","status-publish","format-standard","hentry","category-divorce","category-property"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Spouse May Be Required to Reimburse Community Estate in Texas Divorce &#8212;
