{"id":1035,"date":"2018-06-06T00:02:12","date_gmt":"2018-06-06T05:02:12","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1035"},"modified":"2018-06-06T00:02:12","modified_gmt":"2018-06-06T05:02:12","slug":"texas-court-awards-attorneys-fees-in-child-support-case","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-awards-attorneys-fees-in-child-support-case\/","title":{"rendered":"Texas Court Awards Attorney&#8217;s Fees in Child Support Case"},"content":{"rendered":"<p>In some Texas child support cases, attorney\u2019s fees may be awarded.\u00a0 When a party fails to make child support payments, the court is to order that party to pay the other party\u2019s reasonable attorney\u2019s fees and court costs in pursuing the child support.\u00a0 The court may waive the requirement for attorney\u2019s fees, however, if it finds good cause to do so and states its reasons.<\/p>\n<p>In a <a href=\"https:\/\/cases.justia.com\/texas\/third-court-of-appeals\/2018-03-17-00672-cv.pdf?ts=1528203877\" target=\"_blank\" rel=\"noopener noreferrer\">recent case<\/a>, a father challenged an award of attorney\u2019s fees to the child\u2019s mother. \u00a0\u00a0The father was ordered to pay child support in the divorce decree.\u00a0 He subsequently sued to recover child support payments that he claimed were in excess of his obligation.\u00a0 The mother denied the claims and asserted a counterclaim for back child support, unpaid medical support, and attorney\u2019s fees.\u00a0 The trial court denied the father\u2019s request for overpayments, determined the amount of arrearages that was owed, and awarded the mother that amount.\u00a0 The trial court also found each party was responsible for their own attorney\u2019s fees.<\/p>\n<p>The mother appealed, arguing the trial court should not have credited the father for payments that were made directly to her rather than through the registry of state disbursement.\u00a0 The appeals court affirmed that portion of the order but found the trial court abused its discretion in failing to award the mother attorney\u2019s fees.\u00a0 The appeals court ordered the trial court to award the mother reasonable attorney\u2019s fees or find good cause for denying such an award.\u00a0 The trial court held a hearing and awarded the mother more than $17,000 in attorney\u2019s fees.\u00a0 The father appealed.<\/p>\n<p> <a href=\"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-court-awards-attorneys-fees-in-child-support-case\/#more-1035\" class=\"more-link\">Continue Reading \u203a<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In some Texas child support cases, attorney\u2019s fees may be awarded.\u00a0 When a party fails to make child support payments, the court is to order that party to pay the other party\u2019s reasonable attorney\u2019s fees and court costs in pursuing the child support.\u00a0 The court may waive the requirement for attorney\u2019s fees, however, if it [&hellip;]<\/p>\n","protected":false},"author":11,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[16],"tags":[],"class_list":["post-1035","post","type-post","status-publish","format-standard","hentry","category-child-support"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Texas Court Awards Attorney&#039;s Fees in Child Support Case &#8212;
