{"id":1022,"date":"2018-05-24T00:58:38","date_gmt":"2018-05-24T05:58:38","guid":{"rendered":"https:\/\/www.texasdivorceattorneyblog.com\/?p=1022"},"modified":"2021-09-30T13:38:50","modified_gmt":"2021-09-30T18:38:50","slug":"texas-child-support-modification","status":"publish","type":"post","link":"https:\/\/www.mcclure-lawgroup.com\/blog\/texas-child-support-modification\/","title":{"rendered":"Texas Child Support Modification"},"content":{"rendered":"<p>Sometimes a change in circumstances causes a parent to want to change the amount of child support they are paying or receiving.\u00a0 There are limitations on when a Texas child support order may be modified, however.\u00a0 When the parties had previously agreed to a child support order that is different from what would have been awarded under the child support guidelines, the court may only modify it if there have been material and substantial changes to the circumstances of the child or a person affected by the order.\u00a0 The trial court must look at the circumstances at the time of the order and compare them to the current circumstances.\u00a0 There must be relevant financial information for both periods in the record, as seen in a <a href=\"https:\/\/cases.justia.com\/texas\/first-court-of-appeals\/2018-01-17-00407-cv.pdf?ts=1525350633\" target=\"_blank\" rel=\"noopener noreferrer\">recent<\/a> Texas appeal.<\/p>\n<p>The parents had previously entered into a mediated settlement agreement (MSA).\u00a0 The trial court signed an agreed order naming them joint managing conservators and setting forth visitation schedules and child support obligations.\u00a0 The father was required to pay $490 per month until the child turned 18.\u00a0 The father\u2019s occupation and income were not identified in the MSA or the agreed order.\u00a0 The MSA stated the mother was self-employed but did not provide details.<\/p>\n<p>The mother petitioned for a modification of the child support about five years later.\u00a0 The father did not file an answer or appear at the trial.\u00a0 At the trial, the mother submitted documents from the child\u2019s doctors detailing his diagnoses.
